Alpha Status Notice: Caption Burner is currently in alpha testing. By using this service, you acknowledge that features may change, service may be interrupted, and data may be lost during testing. Use at your own risk.
1. Acceptance of Terms
By accessing and using Caption Burner ("the Service"), you accept and agree to be bound by these Terms of Use. If you do not agree to these terms, please do not use the Service.
2. Description of Service
Caption Burner is a web-based service that automatically generates and burns captions onto vertical videos using AI transcription technology. The Service is currently in alpha testing phase.
3. Alpha Testing Status
Important: This service is in ALPHA testing, which means:
- Features may not work as expected
- Service availability is not guaranteed
- Your data may be lost during updates
- Features may change or be removed without notice
- Service may be discontinued at any time
4. Eligibility
You must be at least 13 years old to use this Service. By using the Service, you represent and warrant that you meet this age requirement.
5. User Obligations
When using the Service, you agree to:
- Provide only content you have the legal right to use
- Not upload content that is illegal, harmful, or infringes on others' rights
- Not attempt to abuse, exploit, or circumvent rate limiting
- Not use the Service for any unlawful purpose
- Not attempt to reverse engineer or hack the Service
- Comply with all applicable laws and regulations
6. Prohibited Content
You may not upload videos containing:
- Illegal content or content promoting illegal activities
- Content that infringes on intellectual property rights
- Hate speech, harassment, or discriminatory content
- Explicit sexual content or child exploitation material
- Violence, threats, or graphic content
- Spam, malware, or malicious code
7. Intellectual Property
7.1 Your Content
You retain all rights to videos you upload. By uploading content, you grant us a temporary, non-exclusive license to process your video solely for the purpose of generating captions. This license terminates when your video is automatically deleted (within 24 hours).
7.2 Our Service
The Service, including its design, code, features, and caption styles, is owned by Caption Burner and protected by copyright and other intellectual property laws. You may not copy, modify, or distribute any part of the Service.
7.3 Generated Captions
You own the captioned videos we generate for you. You are free to use, share, and distribute them as you wish, subject to any third-party rights in the original content.
8. Service Limitations
The Service has the following limitations:
- Video Length: Maximum 90 seconds
- File Size: Maximum 300MB
- Format: Vertical format (9:16 aspect ratio) recommended
- Rate Limit: 5 videos per hour per IP address
- Concurrent Jobs: Maximum 2 concurrent processing jobs per IP
9. Data and Privacy
Your use of the Service is governed by our Privacy Policy. Key points:
- Uploaded videos are automatically deleted within 24 hours
- We do not permanently store your video content
- We use your IP address only for rate limiting
- We collect analytics to improve the Service
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.
We make no warranties that:
- The Service will be uninterrupted, secure, or error-free
- Transcriptions will be accurate or complete
- Any defects will be corrected
- The Service will meet your requirements
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- We are not liable for any indirect, incidental, or consequential damages
- Our total liability shall not exceed the amount you paid to use the Service (currently $0)
- We are not responsible for transcription errors or inaccuracies
- We are not liable for any data loss during alpha testing
12. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Content you upload to the Service
13. Service Modifications
We reserve the right to:
- Modify or discontinue the Service at any time
- Change features, pricing, or limitations
- Refuse service to anyone for any reason
- Remove or modify content as needed
14. Termination
We may terminate or suspend your access to the Service:
- For violation of these Terms
- For abusive or fraudulent behavior
- At our discretion during alpha testing
- Upon discontinuation of the Service
15. Third-Party Services
The Service uses third-party services including:
- OpenAI Whisper for transcription
- FFmpeg for video processing
- Google Analytics for usage tracking
Use of these services is subject to their respective terms and policies.
16. Feedback
Any feedback, suggestions, or ideas you provide about the Service become our property. We may use them without restriction or compensation to you.
17. Governing Law
These Terms are governed by the laws of New York, United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of New York, United States.
18. Changes to Terms
We may update these Terms at any time. Significant changes will be indicated by updating the "Last Updated" date. Continued use of the Service after changes constitutes acceptance of the new Terms.
19. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Caption Burner regarding the Service.
